Violence and abuse towards the Management Office Team

The management and their contractors are entitled to perform their duties without incurring abuse, threats, harassment or violence from residents and the JMC will support them seeking full police action for any breach of this as well as the publishing of their details on the blog/notice boards.

Any disputes should be solved amicably as civilised adults and not with violence and threatening behavior.

Yesterday morning a resident from G-6-6 damaged the management office mirrored window when he started throwing items over an issue with his Astro TV service (which had already been resolved).

Our CCTV system captured the appalling and unacceptable behaviour and a extract of the footage is below:



The Management and the JMC would like to reiterate that this type of behaviour is not acceptable under ANY circumstances and offenders we be passed to the police.

Tower J Breakins

On Friday 20 September between 13:14 and 14:29 several attempted break ins and potentially 1 break in occurred in Tower J.

The 2 or 3 suspects entered in a Honda car WGC 8836 and its is believed that they parked on level P4.

The suspects tried to avoid the CCTV system however some photos were captured and several witness have provided a good description.

The police are now investigating however if anybody has any information regarding this incident then please contact either the Management Office. Security or the JMC.

Pool Water Slide

A small piece of news that we missed  reporting.

The children's waterslide used to only be activated during the evening hours when the pool was most busy to save wear and tear.

We are pleased to announce that an 'on demand' switch has been installed which runs the pump for approx. 10 minutes.

This now means that our children can enjoy the slide at any time during the pool opening hours.

Lift Upgrade Progress

Following the recent post regarding the planned commencement of the lift upgrade works we are disappointed to report that the commencement encountered delayed however the works have commenced today.

The plan was for two teams to work at Towers A & E however the second team has yet to arrive and Team 1 commenced works at Tower B for reasons unbeknown.

The contractor has assured us that they will endeavour to regain lost time and has apologised for the misunderstanding regarding the commencement of works in Tower B.

Private Rental of Parking Bays

Please be advised that residents who rent parking space(s) from private parties must ensure that both the official parking sticker and the car park access card(s) are provided to avoid issues with access, security enforcement and clamping.

Recently several cars have been clamped for parking in a bay without a valid sticker. The root cause of the problem was that the owner of the bay had failed to provide the tenant renting the bay a valid parking sticker and access card as part of the rental agreement.

During the last AGM a motion was passed allowing a limited number of visitor parking bays to be rented out to residents subject to terms and conditions. The demand for these bays has been overwhelming with all spaces taken and enquiries received on an almost daily basis. At the next AGM, JMB members can decide whether or not to allow more visitor spaces to be rented out to residents.

Following the success of the above initiative, the JMC were made aware that one particular unit owned by the developer had approximately 75 parking spaces allocated to it. Although the spaces are clearly shown on the Strata Title Plan, the legality of the situation is still being investigated by our legal team.

Even if it’s legal, the JMC would like to state our disappointment at the immoral approach taken by Setapak Heights for not allocating these spaces as common property in the form of visitor's bays.
To make matters worse, it would appear that the developer has not collected the parking stickers or has the access cards for the parking bays before renting them out

Unfortunately the JMC understands that several residents have paid money in advance to the developer for the use of these bays and have now found that they don’t have stickers and access cards to use the bays owing to the developer again not taking responsibility.

The residents who have rented the spaces are in a difficult situation and perhaps should consider asking for their money back from the developer.

The JMC would like to reiterate the following points:
  • Under Act 663 Building and Common Property (Maintenance and Management) ACT 2007 the JMB are not responsible for issues arising out of private rental agreements between parcel owners/residents
  • The rental of parking bays between owners is a private matter, hence, any dispute over payment or non-delivery of parking stickers/access cards lies solely between the owner of the bay and the person renting the bay
  • The application and collection of stickers must be performed by the parcel owner and details of any tenancy agreements must be provided by parcel owner failing which the application will be rejected










Update on the Fixed Deposits issue

Over the past few years the various JMCs have tried to arrange meetings and correspond with the developer on the above issue, however these invitations are more often than not declined or along with countless letters simply ignored. 

More recently, the developer has agreed to return the fixed deposits but on the condition that the JMB indemnify them for any and all wrongdoing. This proposal was promptly refused and the developer was reminded of its obligation to return the monies pursuant to Section 22 of Act 663 where it is stated that:

Any surplus moneys in the Building Maintenance Account after payment of all the expenditure which have been properly charged to the Building Maintenance Account shall be transferred to the Body by the developer not later than one month from the date of establishment of the Body.”

To-date, the amount being held by the developer is in excess of RM 600k.This comprises of things such as the advanced rental which was paid by parcel owners upon vacant possession.

The JMC are disappointed that Setapak Heights continues to try and force both unreasonable and unnecessary indemnities as well as make other threats which would be detrimental to the wellbeing of the JMB.

Our legal team is now working to resolve the issue and we will endeavour to keep you updated on the situation





Clamping incident at Tower H

We are disappointed to receive a report of an incident on Monday 16/9 involving a tenant from H-10-1 who’s car had been clamped due to illegally parking outside Tower H.

Later that day the resident refused to pay the clamping release fee and the police were called. The police reiterated that the condominium rules must be followed and left.

Following the departure of the police, the resident became unruly and with a help of a friend removed the clamp with a grinding machine.

A police report has been made and the JMB will commence damage recovery proceedings.

The Management and the JMC would like to reiterate that this type of behaviour is not acceptable under ANY circumstances and offenders we be passed to the police.

Cafe Equipment: Lelong / Auction

Dear Residents

Please take note that there will be an auction session conducted by the Kuala Lumpur Magistrate Court official under Seization Notice and Inventory case no A/E,A/O 76.899.08/2013 to recover debts owed by the previous café operator on the ;

Date : 23/9/13 (Monday)
Time : 10.00 am
Venue : Clubhouse cafeteria space

Item to be auctioned off are cafeteria kitchen tools and equipment including tables and chairs. The item are stated in the Inventory listing here: Equipment List
 
Residents who are interested to bid for the equipment are advised to be present in the premise on the stipulated time and date.

Lift Interior Upgrade Plan

Following the announcement in July regarding the approval to commence the lift interior renovation works, the JMC are pleased to announce that the works to upgrade all 27 lifts will commence on Tuesday 17 September in block's A & E.

Two teams will be performing the work meaning that Phase 1 and 2 blocks will be upgraded concurrently. To limit any inconvenience only, 1 lift per block will be closed down at any one time.

The detailed plans per block are tentative and are subject to change at any time. Any major deviations to the plan will be published here.

Debtors Update: 1st September 2013

The latest debtors report is now available for download here: 01/09/13 list of debtors by block

All residents are reminded to check their statements and report any payments that may have been missed to the management office without delay.


Unfortunately we have some very stubborn and perpetual defaulters who are being dealt with by legal action to recover the outstanding amount.

The collection of outstanding service charges funds is a time consuming and often unpleasant job and the JMC would like thank Ben and his team who regularly have to put up with threats of violence and unruly resents throwing things in the office when tacking defaulters.

Additional parking spaces for rental

The management office has 5 more spaces JMB spaces for rental on level P2 sandwiched between Block C & D. The bays no are 637, 638, 639, 640 & 645 for RM120 per month and subject to the same conditions as those previously rented out.

The spaces come with an offical sticker and access card.

Please contact the management office during office hours and please note that these are available on a first come, first served basis.

At the upcoming AGM JMB members will be able decide whether to allow any more visitors spaces to be rented out.

New Gym Equipment

Following the recent notice regarding the gym upgrade, our new heavy duty commercial equipment has arrived.

We have now have 2 treadmills,  2 cross trainer, 3 spinning bikes and 1 multi station work out.

New quality silicon flooring has been installed to muffle off the equipment noise and aid cleaning.

The old equipment will be serviced asap so please bear with us whilst that’s arranged.

To boost security additional CCTV will be installed and a guard will be stationed at the clubhouse to monitor the gym.

The gym will reopen tomorrow for residents to use and the no under 18’s rule will be strictly enforced.

All gym users are required to bring a towel and those without a towel will be denied entry.

Finally Roslan from the management office will be available to assist and advise residents who aren’t sure how to use the equipment correctly or just require advice.







Cafe Update 11/09/13

We would like to provide an update on the long standing cafe issue and apologise for the lack comments due to the need to ensure that the legal situation wasn’t prejudiced in any way.

The JMB are pleased to announce that last month a court order was obtained and on 9th September a court bailiff entered the cafe premises to identify items left behind by the previous operator. The items identified will then be auctioned off in 2 week’s time by the bailiff to offset the rent owed to the JMB.

Following the auction our lawyer will apply for a vacant possession order to seize back the premises and this is expected to take a further month.

We will now begin sourcing for a new operator and will advise when a tender notice is available.

Gym Upgrade & Revised Rules

The Gym is currently receiving a long overdue upgrade and will be closed from 7-9 September. 

To help ensure that the gym is used correctly a guard will be stationed at the clubhouse to help monitor the gym,

Post reopening the following rules will be effective.

Gymnasium rules and regulations (effective 10th Sept,2013)
  1. The gym is strictly for residents only who are 18 years and above.
  2. Children are strictly prohibited in the gym.
  3. All gym users are required to comply with the gym rules. The management reserves the right to refuse a person entry into the gym and / or if the person is already in the gym, to prohibit the person from further usage of the gym.
  4. Gym users should refrain from talking loudly or indulging in noisy activities that may annoy other users.
  5. All gym users must observe the instructions and safety precautions pertaining to the use of the exercise equipment. Gym users will be held responsible for any damage caused to the equipment by them.
  6. All gym users must be properly attired with sports shoes and must bring their own towel ( those without towel will not be allowed into the gym)
  7. Do not hog the machines, Cardio machines are restricted to 20 minutes at peak hours. All equipment shall be shared among gym users at all time.
  8. No equipment shall be removed from the gym. Theft cases will be referred to
  9. the police.
  10. No smoking, alcohol or eating is allowed within the entire compound of the gym.
  11. Usage of the gym is at your own risk, the management shall not be liable for any death or personal injury, arising from the use of the gym.
