One of the long outstanding projects we have is the revision of the traffic flow at the both the entrance and the within the car park.
We are pleased to share that all the work orders have been approved for the revised traffic flows at both Post 1 and 2.
As well as moving the barriers, ironwork, cameras etc, new signage will also be installed which will include signage attached to the barriers and signs clearly indicating which lane people should take.
Owing to multiple contractors being involved we are awaiting a confirmed installation date which should be in around 2-3 weeks time.
The revised flow at the guardhouse is available here: Post 1&2 Revised Flow
The plan to shift visitor parking entry to Post 1 is still being finalised however its likely to happen once the entrance flows have been changed.
In addition to this a revised traffic flow plan for the car park has been finalised which will remove the errors with the existing design. The signage plan is currently being worked upon and should be completed within the next few weeks following which the work orders can be issued.
The proposed car park flow change will be shared asap.
The revised signage will hopefully address the current issues where by visitors parking cannot be found, there are no clear exit signs and no clear directions to other levels.
There are some ideas around the painting of all pillars and creating zones however these are likely to be out of scope of the current works and will be looked at in the future.
The main objective of this blog is to provide offical information on what the JMC and now the MC are doing and as a newsletter to residents. This blog is a voluntary effort from residents and should any of the residents wish to provide feedback then please contact the MC.

Illegal Grille Removal
All owners are reminded that the installation of grilles in the common area is not permitted under any circumstances.
Unfortunately several penthouse units have installed such grilles and despite multiple requests from the Management Office and our lawyer they refused to remove their grilles.
Owing to the unit owners continued refusal to co-operate, enforcement activities have commenced to remove the illegal grilles.
The remaining grilles will be removed as soon as possible.

Cafe Update 16 Dec
Following the recent tender process we received a moderate amount of interest from potential operators however only a few submissions were actually received and after careful review these didn’t meet the criteria required.
We are currently looking at few interesting ideas from some fairly large players in addition to continuing to seek a suitable operator.
The current situation is both disappointing and extremely frustrating and any interested, experienced and suitable operators should contact the management office to seek further information.

Intercom Update
There are tentative plans to replace the broken intercom system with a PABX type system linked to a phone number provided by the resident.
Owing mainly to resourcing and budget issues this work hasn’t progressed.
We are pleased to share that the requirements are now being defined and a formal resolution will be tabled next months AGM.
Assuming that it’s both approved and there is budget then the new JMC will preside over the final approval.

Linkbridge Gates, CCTV and Lobby Door Update - 16 Dec
We are pleased to announce that the contractor for the Ironwork and lobby doors has finally be appointed and work should commence in the next 2 weeks.
The CCTV covering these many points is now operational although some adjustments will probably be needed once the everything is installed.
Once everything is installed it will ensure a greater level of access control to each block and hopefully provide a much safer environment for us to live in.

November 2013 Debtors Update
The latest debtors report is now available for download here: 30/11/13 list of debtors by block
We are pleased to highlight following a lot of enforcement work over the past 1-2 months the debt level is decreasing and is now at the lowest level ever. Nevertheless their is still a lot of work to be done and we are determined resolve the issue with debtors.
All residents are reminded to check their statements and report any payments that may have been missed to the management office without delay.
Currently there are several major disputes owing to sub sale issues whereby an outstanding amount wasn’t settled during the sale process and they have now found that they are liable for any sums owed.
Any sums owed are attached to the unit and not an individual so it will not be possible for the JMB to either write it off or commence recovery proceedings from a previous owner.

Lift Interior Update
We have recently encountered some delays to the lift interior renovation works owing to sub-contractor & materials issues.
The works are due to recommence next week and a revised plan is available to view and the contractor will increase manpower at the site meaning that the latest plan will actually see the project completed early.
In addition to the new interior we are also upgrading the door safety sensors to the full height variant, meaning that an infra-red sensor running along the full height of the doors will prevent them from closing if an obstruction is present.
This will prevent the current situation when the doors can close, giving people or their bags a big whack!

RE : INCREASE IN ASSESSMENT RATES BY DBKL

We hereby invite unit owners to come forward to the management office to sign the petition letter to be presented to the DBKL at a later date.

Surau Upgrade Proposal
One of the key facilities that should have been provided by the developer was a Surau for our large and active Muslim community.
For the past few years the JMC have provided a temporary solution by allowing use of one the small meeting rooms next to the gym. Unfortunately this is now far too small and offers no segregation for females.
Our Surau committee recently submitted a petition for a larger space to be allocated and this is supported by the JMC.
It is proposed that the wall between the Surau and the meeting room be demolished to provide a much larger space. In addition to this the current GYM door will be relocated opposite the cafeteria.
The library on the 1st floor of the clubhouse has been closed for several years owing to constant misuse and with the closure of the current meeting room this will be converted to a meeting room/office.
A drawing of the proposed new Surau layout is available here: New Surau Plan
This proposal will be formally submitted to the JMB at the next AGM for all members to vote on.

2013 AGM update
There have been several recent enquiries regarding the date of the 2013 AGM.
Owing to preparation issues the plan to hold it earlier this month clearly didn't materialise.
We are currently trying to finalise the proposed 2014 budget so that it has little or no impact on residents and services are not unduly reduced if no service charge increase occurs. We will communicate more this once the proposal is completed.
Once everything is ready formal notices will be issued to each unit giving one months notice. Looking at the current date we anticipate a late November or early December AGM.

Pedestrian Access Control
The access control system for pedestrian entry has finally been installed and is now active.
All pedestrian visitors or residents without access cards will need to register at the guardhouse.
Please note that entry/exit at guardhouse 3 is for residents with access cards only.
All other persons must travel via guardhouse 1 or 2.
There is still some snagging works to complete and temporary signage has been installed.
Based on experience its likely that some people will try to refuse the follow the system and cause an issue. The security company have been informed to strictly enforece this and we ask for your coperation to help make Villa Wangsamas a safer environment for everybody.

Lift Interior works update
The upgrade of the lift interiors has commenced although there are some delays due to sub contractor issues. The Management Office team and the JMC are working to try and resolve these problems and our lift contractor has assured us that they will make up the time later on.
Several lifts have been partially completed and whilst we are awaiting some snagging works and the fitting of the new door sensors it was decided to leave the protective plastic film in place to protect the interior.
We are extremely disappointed to note that that this film has been partially pulled off by several people with at least one person interfering with our CCTV system.
The management office are currently tracking these persons down and they are likely to be fined for damaged caused.
A notice will be added to remind residents not to remove the plastic film.
If anybody knows the persons in the video then please contact the management office or JMC in the strictest confidence.

Violence and abuse towards the Management Office Team
The management and their contractors are entitled to perform their duties without incurring abuse, threats, harassment or violence from residents and the JMC will support them seeking full police action for any breach of this as well as the publishing of their details on the blog/notice boards.
Any disputes should be solved amicably as civilised adults and not with violence and threatening behavior.
Yesterday morning a resident from G-6-6 damaged the management office mirrored window when he started throwing items over an issue with his Astro TV service (which had already been resolved).
Our CCTV system captured the appalling and unacceptable behaviour and a extract of the footage is below:
The Management and the JMC would like to reiterate that this type of behaviour is not acceptable under ANY circumstances and offenders we be passed to the police.
Thank you for your cooperation.

Pool Water Slide
A small piece of news that we missed reporting.
The children's waterslide used to only be activated during the evening hours when the pool was most busy to save wear and tear.
We are pleased to announce that an 'on demand' switch has been installed which runs the pump for approx. 10 minutes.
This now means that our children can enjoy the slide at any time during the pool opening hours.

Private Rental of Parking Bays
Please be advised that residents who rent parking space(s) from private parties must ensure that both the official parking sticker and the car park access card(s) are provided to avoid issues with access, security enforcement and clamping.
Recently several cars have been clamped for parking in a bay without a valid sticker. The root cause of the problem was that the owner of the bay had failed to provide the tenant renting the bay a valid parking sticker and access card as part of the rental agreement.
During the last AGM a motion was passed allowing a limited number of visitor parking bays to be rented out to residents subject to terms and conditions. The demand for these bays has been overwhelming with all spaces taken and enquiries received on an almost daily basis. At the next AGM, JMB members can decide whether or not to allow more visitor spaces to be rented out to residents.
Following the success of the above initiative, the JMC were made aware that one particular unit owned by the developer had approximately 75 parking spaces allocated to it. Although the spaces are clearly shown on the Strata Title Plan, the legality of the situation is still being investigated by our legal team.
Even if it’s legal, the JMC would like to state our disappointment at the immoral approach taken by Setapak Heights for not allocating these spaces as common property in the form of visitor's bays.
To make matters worse, it would appear that the developer has not collected the parking stickers or has the access cards for the parking bays before renting them out
Unfortunately the JMC understands that several residents have paid money in advance to the developer for the use of these bays and have now found that they don’t have stickers and access cards to use the bays owing to the developer again not taking responsibility.
The residents who have rented the spaces are in a difficult situation and perhaps should consider asking for their money back from the developer.
The JMC would like to reiterate the following points:

The JMC would like to reiterate the following points:
- Under Act 663 Building and Common Property (Maintenance and Management) ACT 2007 the JMB are not responsible for issues arising out of private rental agreements between parcel owners/residents
- The rental of parking bays between owners is a private matter, hence, any dispute over payment or non-delivery of parking stickers/access cards lies solely between the owner of the bay and the person renting the bay
- The application and collection of stickers must be performed by the parcel owner and details of any tenancy agreements must be provided by parcel owner failing which the application will be rejected
Update on the Fixed Deposits issue
Over the past few years the various JMCs have tried to arrange meetings and correspond with the developer on the above issue, however these invitations are more often than not declined or along with countless letters simply ignored.
More recently, the developer has agreed to return the fixed deposits but on the condition that the JMB indemnify them for any and all wrongdoing. This proposal was promptly refused and the developer was reminded of its obligation to return the monies pursuant to Section 22 of Act 663 where it is stated that:
“Any surplus moneys in the Building Maintenance Account after payment of all the expenditure which have been properly charged to the Building Maintenance Account shall be transferred to the Body by the developer not later than one month from the date of establishment of the Body.”
To-date, the amount being held by the developer is in excess of RM 600k.This comprises of things such as the advanced rental which was paid by parcel owners upon vacant possession.
The JMC are disappointed that Setapak Heights continues to try and force both unreasonable and unnecessary indemnities as well as make other threats which would be detrimental to the wellbeing of the JMB.
Our legal team is now working to resolve the issue and we will endeavour to keep you updated on the situation

Clamping incident at Tower H
We are disappointed to receive a report of an incident on Monday 16/9 involving a tenant from H-10-1 who’s car had been clamped due to illegally parking outside Tower H.
Later that day the resident refused to pay the clamping release fee and the police were called. The police reiterated that the condominium rules must be followed and left.
Following the departure of the police, the resident became unruly and with a help of a friend removed the clamp with a grinding machine.
A video showing the shocking and unacceptable behaviour can be seen below:
A police report has been made and the JMB will commence damage recovery proceedings.
The Management and the JMC would like to reiterate that this type of behaviour is not acceptable under ANY circumstances and offenders we be passed to the police.
Thank you for your cooperation.

The latest debtors report is now available for download here: 01/09/13 list of debtors by block
All residents are reminded to check their statements and report any payments that may have been missed to the management office without delay.
Unfortunately we have some very stubborn and perpetual defaulters who are being dealt with by legal action to recover the outstanding amount.
The collection of outstanding service charges funds is a time consuming and often unpleasant job and the JMC would like thank Ben and his team who regularly have to put up with threats of violence and unruly resents throwing things in the office when tacking defaulters.
